Parental Relocation

South Florida Parental Relocation Attorney

If you are involved in a child custody plan, picking up and moving is not as easy as it seems. You will have to obtain approval from the court before you can make a move that would drastically alter your current child custody plan. However, with the right lawyer, parental relocation is possible. At the Fort Lauderdale offices of the Stella Law Firm, we help families with parental relocation and "moving away" concerns.

Florida Statute 61.0013 details what a custodial parent must do in order to be awarded parental relocation. There are a number of prescriptions that must be followed properly, even exactly, if one parent wishes to move fifty miles or more away from the non-relocating parent.

Parental relocation has an adverse impact on non-relocating parents and their opportunities to be involved with the lives of their children. This is why Florida state courts enforce the laws regarding all potential relocations. The courts also understand that your lives change. Whether you want to move for a better job opportunity, cheaper housing, or family support, the court will do what they believe is in the best interest of the children.

If you are interested in making a move with your children, the first thing we will do is draft a relocation petition and notify the relocating parent in the manner demanded by the law. This will demonstrate to the court why the move is in the best interest of your children.

Our firm has successfully relocated numerous parents to and from South Florida. Many parents believe it is a no-win situation, but we know how to draft appropriate visitation schedules, emphasizing school vacation and summer periods, to come up with plans that work for all types of families; plans that will be approved by the courts!
